Terms of Service

1. What we provide

NearMax is a product of Saiatech LLC, an Arizona limited liability company.NearMax builds, hosts, and manages professional websites for trade businesses. Your subscription gives you a live website on our infrastructure, ongoing hosting, SSL, and the ability to request changes to your site.

2. Subscription and payment

Subscriptions are billed monthly. Your card is charged on the same date each month. You can cancel at any time from your dashboard — your site stays live until the end of the current billing period and is taken offline after that.

We do not offer refunds for partial months. If a payment fails, we’ll notify you and give you a grace period to update your payment method before the site is paused.

3. Your content

You own all content you provide to us — business name, description, photos, and any other materials. By submitting content you grant us a licence to publish it on your website. We do not sell or share your content with third parties.

You are responsible for ensuring you have the rights to any content you submit, including photos and logos.

4. Acceptable use

You may not use NearMax for any unlawful purpose, to publish harmful or deceptive content, or to impersonate any person or business. We reserve the right to suspend or terminate accounts that violate these terms.

5. Site changes

Change requests are handled by our team and are typically completed within a few business days. We make reasonable efforts to fulfil requests accurately but cannot guarantee specific outcomes for requests that are vague or technically infeasible.

6. Uptime and availability

We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance, infrastructure failures, or force majeure events may cause temporary downtime. We will make reasonable efforts to restore service promptly.

7. Limitation of liability

NearMax is provided “as is.” To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages including lost revenue or business opportunities arising from use of the service.

8. Changes to these terms

We may update these terms from time to time. We’ll notify you by email at least 7 days before any material change takes effect. Continued use of the service after that date constitutes acceptance of the updated terms.
