Caller privacy notice

Version 2026-10-17 | Last updated: October 17, 2026

Businesses that use NearMax Office to answer their phones publish a notice like this one for their callers. NearMax fills it in from each business’s settings and can host it for them. This page shows the template; highlighted text in braces is replaced for each business.

Sample notice

How {Business} handles your calls

When you call {Business}, an AI assistant may answer for us. Here is what that means for your information.

  • What we collect: your phone number, what you tell us on the call (such as your name, address and the service you need), a recording and transcript of the call, details of your equipment, and any appointments or callbacks you request.
  • Why: to answer your questions, book and manage appointments, help troubleshoot equipment, call you back if you ask us to, and keep a record of your service.
  • Remembering past calls: we keep a short summary of earlier calls so we can pick up where we left off. Press 2 at the start of a call if you don't want the call recorded or remembered.
  • Who handles it: our service providers, including NearMax (Saiatech LLC), which runs the AI assistant, and the phone and AI companies it uses. They may use your information only to provide services to us. NearMax and its providers never use your information to train AI models. {If you use your own AI provider instead of NearMax's, replace this sentence with a description of that provider's practices.}
  • We do not sell or share your personal information for advertising.
  • How long we keep it: {1 year} unless we need it longer for your service or the law. If you opted out, a short note of the call is kept for 30 days.
  • Your choices: you can ask us to access, correct or delete your information, or to stop calling you, by contacting {contact email or phone}. We won't treat you differently for making a request.
  • Questions: {contact email or phone}.

What the placeholders mean

{Business}
The business's name, as set in its NearMax Office settings.
{1 year}
How long the business keeps call records. It comes from the business's retention setting (1 year by default).
{If you use your own AI provider …}
Removed for businesses on the NearMax AI model. A business that connects its own AI provider gets a sentence naming that provider instead.
{contact email or phone}
Where callers send privacy requests. The business enters this in its settings.
{date}
When the business's notice last changed.

What callers hear

Every call starts with an AI and recording disclosure and a way to opt out. These are the scripts the AI uses ({Business} is the business name).

MomentScript
Opening, before the AI connects"Thanks for calling {Business}. You're speaking with an AI assistant. This call is recorded and may be remembered to help with future calls. To not have this call recorded or remembered, press 2 now."
Caller pressed 2"Okay, this call won't be recorded or remembered."
Emergency described"That sounds like it could be an emergency. Please hang up and call 911 right away. If you smell gas, leave the area first and call your gas company from outside. I'm letting {Business} know now."
Starting troubleshooting"I can walk you through a few simple checks from the manual. If anything feels unsafe at any point, stop, and we'll get a technician out instead."
Step needs a technician"That part needs a trained technician, so I won't walk you through it. I can book a visit for you."
Saving progress (opted-out caller)"Want me to save where we got to, so you can pick up if you call back? I'll keep just the troubleshooting steps for 7 days."
Unknown number, same household"Can you tell me the name on the account and the service address?" The AI never reads details back.
Asking for callback consent"Would you like {Business} to call you back about this?" Then: "Just to confirm, it's okay for us to call you back at this number?" A clear yes is recorded as consent.
Outbound callback opening"Hi, this is the AI assistant for {Business}, calling back about what you called about on {day}. This call is recorded. Is now a good time?"
Caller declines further calls"Understood, we won't call you again." The number is added to the business's do-not-call list.
Urgent transfer, connecting"Okay, I'm connecting you to someone at {Business} now. Please hold."
Urgent transfer not answered"Sorry, no one at {Business} could pick up right now. I've marked this as urgent, and someone will call you back as soon as they can. You can also leave a short message after the tone."
Urgent transfer not answered (caller opted out)"Sorry, no one at {Business} could pick up right now. I've marked this as urgent, and someone will call you back as soon as they can. Since this call isn't being recorded, we can't take a message. Goodbye." No recording is made.
Payment asked for"I can't take card details over the phone, but I can have a payment link emailed to you."

How NearMax handles this information for the business is set out in the Data Processing Addendum.
